Defect Description:

ENGINE

Potential Consequences:

Both the UPPER and LOWER active grille shutters for most BMW models in the 5 model years prior to mine had extended service warranties due to frequent failures of the part. It appears that the design was not improved with my model year and yet my vehicle is NOT part of the extended warranty. My vehicle is only 4 years old and BOTH the upper and lower air flap control motors have failed. The motors are not sold individually, but are sold as a part of the entire shutter assembly which has a part cost of $250 - $350 each with comparable installation costs. The lower shutter assembly requires the removal of the entire bumper. Why is the extended service warranty not applicable to newer models?

STRUCTURE:BODY

Potential Consequences:

I have been in the motorcycle industry 1988-2000 and the auto industry since 2000 to current, a break for about 10 years in there. I am fairly mechanically knowledgeable. On 8/1/2 was showing a customer a BMW 330I that we had in inventory. The customer sat in the driver's seat, started the engine and popped the primary hood latch. I was at the front on the vehicle. Since I deal with every make, model and years finding the secondary latch release can be challenging. Initially, I felt under the hood at the center, not finding it I proceeded to feel my way down both sides of the hood. Still not finding the release I inserted my right hand into the grill at first grill opening center right (drivers side). I was feeling inside to find the elusive release. About 1-2 seconds of feeling around I felt the a pressure against my hand. There isn't much space in the grill openings and very quickly I could not remove my hand in time, it was pinched between the vertical grill vent and, at that point unknown, active grill venting. My hand was stuck and the active grill venting continued to close since it indicated the cycle was not complete. I was stuck and it was very painful. My right was stuck in the first opening and I tried to overpower the electric motor with my left hand on the second grill opening (drivers side) I could not overpower it. I slowed it but it continued trying to close. I told the customer that I was stuck and in pain and that I needed help. I could not pull hand out since it was never intended to have a hand in there, the edges where sharp plastic on the inside, almost like a barb. It took me, being one handed and both his hands pushing on the vents to over power the system. Without the second adult male, I was trapped. Issues: 1. excessively overpowered 2. no reverse sensor like auto up passenger windows 3. no break-away safety system

Additional Notes:

AIR BAGS

Potential Consequences:

Car was t-boned by another vehicle at 65-70 MPH (other driver was cited as negligent and responsible for accident)—and other driver’s car caused damage to the BMW and driver (my daughter) due to the side airbags on the BMW not deploying (damage to daughter would have been significantly less had the BMW side airbags deployed as they should have upon impact).

Potential Consequences:

MY VEHICLE WAS PARKED IN A DRIVEWAY. PRIOR TO PARKING, I HAD FOLLOWED THE MANUFACTURER'S INSTRUCTIONS ON HOW TO HAVE MY CAR MEMORIZE THE LAST 100 FEET DRIVEN IN ORDER TO USE THE BACKUP ASSIST FEATURE. WHEN I STARTED MY VEHICLE, I ACTIVATED THE BACKUP ASSIST FEATURE FOLLOWING THE MANUFACTURERS INSTRUCTIONS. MY VEHICLE RESPONDED ACCORDINGLY AND THE BACKUP ASSIST FUNCTIONED NORMALLY FOR THE FIRST FEW SECONDS. THE BACKUP ASSIST THEN DISENGAGED AND MY CAR ACCELERATED BACKWARDS, WENT OFF ITS TRACK AND BACKED FORCEFULLY INTO A BRICK WALL BEFORE I COULD APPLY THE BRAKES. DAMAGE TO THE REAR OF THE CAR WAS EXTENSIVE. I DID HAVE THE CAR EVALUATED BY BMW ENGINEERS FOR POTENTIAL DEFECTS IN SOFTWARE OR SENSORS, BUT I WAS TOLD THAT THE SYSTEM FUNCTIONED AS INTENDED. MY RESPONSE IS THAT THE SYSTEM IS INHERENTLY UNSAFE IF IT CAN DISENGAGE AND ACCELERATE IN REVERSE WITHOUT DRIVER INPUT. IN ADDITION, MY VEHICLE IS STILL IN THE REPAIR SHOP AWAITING CERTAIN PARTS FROM GERMANY.
